IMPORTANT NOTICE: Where permitted by law, these Terms require (with limited exceptions) that disputes between you and Zombie RX, LLC be resolved through binding, individual arbitration instead of in court, and include a class action and jury trial waiver.

These Terms & Conditions (“Terms”) govern your access to and use of the Zombie RX website, including any content, features, purchases, and services offered through the site (collectively, the “Services”). The Services are operated by Zombie RX, LLC (“Zombie RX,” “we,” “us,” “our”).

By accessing or using the Services (including by placing an order), you agree to these Terms. If you do not agree, do not use the Services.

1) Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase Products through the Services. By placing an order, you represent you meet this requirement.

2) Products, Use, and Common Sense

We sell coffee and related products, merchandise, and other items we choose to offer (“Products”).

  • Read ingredients and labels before consuming anything.
  • If you have allergies, sensitivities, or medical concerns, consult a qualified professional.
  • Nothing on the Services is medical advice.

3) Orders, Pricing, and Availability

3.1 Pricing / Errors. Prices, promotions, and availability can change without notice. If we discover an error (including pricing, descriptions, availability), we may correct it and/or cancel the order.

3.2 Order Acceptance. Your order is an offer to buy. We may accept, decline, limit, or cancel any order at our discretion, including for suspected fraud, inventory limitations, shipping restrictions, or violations of these Terms. If we cancel after you’ve been charged, we’ll refund the amount paid for the cancelled item(s).

3.3 Shipping. Shipping timelines are estimates, not prophecies. Risk of loss passes to you upon delivery to the carrier, unless applicable law says otherwise.

3.4 Returns / Refunds. Returns and refunds are governed by our posted policies (if any) and applicable law. If you maintain a Return Policy and Shipping Policy page, those policies are incorporated by reference into these Terms.

4) Account Registration (If Offered)

If you create an account, you’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts at any time if we believe there’s fraud, abuse, or a violation of these Terms.

5) SMS / Text Messages (If You Opt In)

If you opt into SMS, you consent to receive recurring automated marketing and informational messages (including cart reminders) at the number provided. Message/data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out, HELP for help.

6) User Content (Reviews, Photos, Submissions)

If you post, upload, send, or submit content (including reviews, photos, videos, comments, or other materials) (“User Content”):

  • You represent you own or have rights to share it.
  • You agree it won’t be unlawful, defamatory, obscene, misleading, or infringing.
  • You agree not to include anyone else’s personal information without permission.
  • If you received free product, discounts, or anything of value in connection with a review/post, you must disclose that relationship as required by law (including FTC endorsement guidelines).
  • License to us. You grant Zombie RX a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, display, and distribute your User Content in any media for any lawful purpose.

We may remove User Content at any time for any reason.

7) Intellectual Property

All content on the Services (including text, graphics, logos, product names, designs, images, and site “look and feel”) is owned by or licensed to Zombie RX and protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not copy, sell, exploit, or create derivative works from our content without written permission.

8) Prohibited Conduct

You agree not to:

  • Violate any law while using the Services
  • Attempt to access non-public systems, data, or accounts
  • Interfere with security features or site operation
  • Use bots/scrapers/crawlers/data-mining tools to access or copy the Services without permission
  • Use our content to train or develop AI/ML models without express written consent
  • Submit fraudulent orders, payment methods you don’t have rights to use, or chargebacks in bad faith

9) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and Products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10) Limitation of Liability

To the fullest extent permitted by law, Zombie RX and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits/revenue/data/goodwill, arising from or related to your use of the Services or Products.

Where liability cannot be excluded, our liability will be limited to the amount you paid to us for the Product(s) giving rise to the claim, unless applicable law requires otherwise.

11) Indemnification

You agree to defend, indemnify, and hold harmless Zombie RX and its affiliates and representatives from claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from: (a) your use of the Services, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any law or third-party rights.

12) Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules, except where federal law applies.

13) Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY.

13.1 Informal Resolution First. Before filing a claim, you agree to contact us at submit@officialzombierx.com with a written notice describing the issue and the relief you’re seeking. Both sides will attempt to resolve it informally for at least 60 days.

13.2 Binding Individual Arbitration. If not resolved, any dispute or claim arising out of or relating to the Services or these Terms will be resolved through binding, individual arbitration, not in court, except that either party may:

  • bring eligible claims in small claims court, and/or
  • seek injunctive or other relief in court for intellectual property infringement (copyright, trademark, trade secret).

Arbitration will be administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules, and will be conducted on an individual basis only (no class procedures).

13.3 Class Action & Jury Trial Waiver. To the fullest extent permitted by law, you and Zombie RX agree that each may bring claims only in an individual capacity, and waive any right to a jury trial and any class/collective/private attorney general action.

13.4 30-Day Opt-Out Right. You may opt out of arbitration within 30 days of first accepting these Terms by emailing submit@officialzombierx.com with: (i) your name, (ii) the email used for orders/account, and (iii) a clear statement that you want to opt out of arbitration.

14) Third-Party Links

The Services may link to third-party websites. We don’t control them and aren’t responsible for their content, policies, or practices.
